Revocation Of Article 370: Good or bad?

After the week of intense speculation, on 5th august 2019 abrogation of article 370 took place in Jammu and Kashmir, creating history, and breaking news in Hindi, English, Tamil, Kannada, Punjabi, Oriya, Malayalam, Marathi and other regional languages. The seemingly impossible task has been accomplished, all to the cheer of many citizens hoping for a better future.

During the time of preparation, before the abrogation, the valley witnessed increased security. Many political leaders were under house arrest, and the government inflicted a curfew in the state, per ETV Bharat Latest News. The government annulled the Amarnath Yatra; pilgrims and tourists were asked to return back to their home states, a very rare case otherwise. The residents of Kashmir experienced a virtual lockdown and were not allowed to step out of their respective homes. The residents were requested to stock enough supplies at their homes. The schools and colleges were shut, as a precautionary measure. The communication and internet lines were under suspension during this time. 

What exactly is the article 370?

When India got independence, there were many princely states back then that joined India, but some wanted to stay independent, one of them was Kashmir. However, when Pakistan attacked J&K, petrified Hari Singh called Pandit Jawaharlal Nehru leading to J&K’s accession to India. 

Article 370, was launched in 1952, and per the article, J&K was a self-governing state except the foreign affairs, ancillary matters, defense, and communications. Till 1965 J&K had its flag and constitution since the provision allowed them to have Sardar-e-Riyasat. The state has separate laws for citizenship, fundamental rights, ownership of property, etc. 

What does the new order imply?

According to the order 2019, all the laws of the Indian constitution will henceforth apply to Jammu and Kashmir. 

Can parliament amend the constitution?

 As per the legislative rules of the Lok Sabha money bills can’t be passed just by calling a joint session. The Lok Sabha has a total strength of 543 members and there are 336 members of Bhartiya Janta Party in the Lok Sabha. The amendment shall require over 362 MPs votes and to make this possible BJP needed votes from other regional parties. It was tricky for the government to amend the constitution for the revocation of article 370.

Won’t Kashmiris Be More Resentful Now?

While many citizens are rejoining, some believe that this could make small sections of Kashmiris more resentful. 

Modi government has leveraged the majority position in the Lok Sabha and abolished article 370 with great planning. If we talk about the history of this article, then this article was meant to be abolished, over time. Some folks think that this step could develop aggressiveness in the Kashmiri people, but the majority think that this decision has revived the land of Kashmir. Now, the future will tell about the results of the revocation of article 370 until then we can only hope that serenity remains among the states of J&K.
